2018年7月,联合国国际贸易法委员会（“贸法会”）完成了《联合国关于调解达成的国际和解协议公约》（“《和解协议公约》”）的起草，并将在今年提交联合国大会通过后向成员国开放签字。公约旨在通过建立国际商事调解协议跨国执行机制，进一步推动国际商事调解的发展。调解作为多元化争议解决机制的组成部分，在中国对外开放四十年的历程中一直发挥着重要作用，可以预见，《和解协议公约》的签署和施行将对中国对外开放的发展和营商环境的改善产生积极影响。

In July 2018, the United Nations Commission on International Trade Law (“UNCITRAL”) finalized the draft UN Convention on International Settlement Agreements Resulting from Mediation (“Mediation Convention”), which will be open for signature of UN Member States after its adoption later this year by the General Assembly of UN. The Mediation Convention is for the purpose of fostering the use of mediation for international commercial disputes and establishing a cross-border enforcement mechanism for international commercial settlement agreements. Mediation, serving as part of the multiple dispute resolution mechanism, plays an important role all along the 40 years’ history of China’s Reform and Opening, it’s foreseeable that the signing and implementation of the Mediation Convention will have a positive impact on the development of China's opening-up and the improvement of China’s business environment.
